The Governor of Cross River State , Prof . Ben Ayade, will swear in a new acting Chief Judge for the state on Monday , amid protest against the move by some lawyers .
Cross River State has been without a substantive Chief Judge since September 3 after the expiration of the tenure of Justice Maurice Eneji , who was the state ’ s acting Chief Judge .
Ayade’ s the Special Adviser on Media and Publicity , Christian Ita , said , in a statement on Sunday , that the governor will, “ in the exercise of his powers under section 271 (4 ) of the 1999 Constitution of the Federal Republic of Nigeria (as amended ), ” swear in a new acting Chief Judge of the state on October 19 , 2020 (today ).
“ This follows the recommendation of the National Judicial Council ,” the statement noted .
But a group of legal practitioners , under the aegis of Concerned Lawyers , have disclosed their plan to protest against the long absence of a substantive Chief Judge on Monday .
Reacting to the government ’ s decision to swear in a new acting Chief Judge , the lawyers said Ayade ’ s move was pre -emptive of their planned protest .
